Sir,
have the honour to report that in September
last a Subadar in the 126th. Baluchistan Infantry was murdered in
the Shameen at Canton, where part of the regiment was stationed, and a private in the same regiment was arrested on the charge of having committed the murder.

The Judge of His Majesty's Supreme Court for China issued a warrant under Article 50 of the China and Corea
Order in Council, 1904, for the trial of the accused in this Colony, which took place accordingly. The jury disagreed and a new trial was ordered, with the result that the prisoner was found guilty, but sentence was postponed pending the consideration by the Full Court of certain points of law put forward by the defence. These were decided against the prisoner and on the 16th. December the Chief Justice sentenced him to death but granted a respite of the sentence in order to give opportunity to apply for leave to appeal to the Privy Council on the legal points raised. It is understood that the application for leave to appeal will shortly
go forward.

I enclose for your information a copy of the sentence passed by the Chief Justice together with two reports by the Attorney-General on the case. These documents furnish a brief summary of the facts which may be useful if the Privy Council should require notice of the application for leave to appeal, which
